Summary
  • A fourth victim, Jane Doe 4 from Wyoming, has joined the lawsuit against xAI over CSAM generation.
  • Her stepfather created more than 7,000 fake explicit photos using Grok, including an image from her childhood at age 11.
  • The class action claims it could encompass at least thousands of minors.
  • California and the EU launched investigations into xAI and the X platform in January 2026.

A fourth person has joined the legal action against xAI, alleging that its AI chatbot Grok was used to create child sexual abuse material (CSAM) based on her childhood photos. The Wyoming woman, identified in the lawsuit as Jane Doe 4, stated that her stepfather used Grok to create "thousands of sexually explicit photos of her as a child and shared them online," as reported by the Washington Post and relayed by Klix.ba.

According to the lawsuit, the stepfather created more than 7,000 "fake explicit photos of her using the AI chatbot Grok." Among them is a photo taken when she was 11 years old that was transformed into a sexually explicit image. After state and local law enforcement searched her stepfather's electronic devices for CSAM, he was found dead in his car two days later, with the cause determined to be suicide.

Class Action Covers Thousands of Minors

Jane Doe 4 joins three teenage girls from Tennessee who filed the original lawsuit, which alleges that Grok was used to create sexually explicit deepfake photos of them. The class action now claims it could encompass "at least thousands of minors."

Investigations in California and the EU

Beyond this lawsuit, xAI and Grok have come under scrutiny in multiple CSAM-related investigations. In January 2026, California Attorney General Rob Bonta launched an investigation into xAI, accusing the company of generating unauthorized deepfake nude photos of women and children. Later that month, the European Union also initiated its own investigation into the X platform to determine whether it has adequate measures to prevent the spread of AI-generated CSAM.

At the time of publication, xAI had not responded to a request for comment on the latest expansion of the lawsuit.
