An emergency medical worker from Virovitica, 43-year-old Toni, got behind the wheel under the influence of alcohol again just ten days after a driving ban was imposed on him for the same offense. According to this week's ruling, he was found in his Volkswagen in Špišić Bukovica with a blood alcohol level of 1.65 promille.
In addition to the high alcohol concentration, police determined that he was driving despite a legally binding two-month driving ban, which had been imposed on him precisely for drunk driving. The ban had by then been entered into the official records of drivers and driving licenses.
Toni admitted the offense in court and described the circumstances that led to it. "I was returning home after helping a colleague with construction work. I drank a meter and beer while working," he said during the trial.
Regarding the ban, he claimed he was not aware it had taken effect. "I didn't see that my driving ban had started; I only saw that penalty points had been recorded," he defended himself.
The court sentenced him to 25 days of suspended imprisonment for the new offense, with two days spent in police custody deducted from the sentence. Additionally, he was given a new six-month driving ban. He is also required to pay 37 euros in court costs.
According to the ruling, Toni is employed as an emergency driver and earns about 1,200 euros per month. In determining the sentence, the court took into account that he repeated the same offense extremely quickly after the previous final judgment, which indicates his prior culpability.
