Mobile Homes Without a Permit: What Does the New Regulation Bring?

The proposal, open for public consultation until September 3, defines what can be built and renovated without a building permit, with the biggest changes affecting campsites and smaller residential units.

The Ministry of Physical Planning, Construction and State Assets has released for public consultation a draft of the new Regulation on buildings and works for which no building permit is required. The document introduces significant changes compared to existing rules, with the most attention drawn to provisions on mobile homes in campsites and the expansion of renovation options without obtaining a permit.

Mobile Homes in Campsites: No Permit, But with Restrictions

The biggest novelty concerns the so-called single-story modular-prefabricated, or mobile, homes. These can now be installed without a building permit or main project, but only within the campsite area and in accordance with the conditions of the location permit on the basis of which the campsite obtained its use permit and operating license. Each individual mobile home may have a maximum area of 40 square meters and a height of up to 3.5 meters.

For existing campsites, mobile homes may be placed in the zone between 25 and 100 meters from the sea, but only if this is stipulated in the location permit and if the campsite meets a built-up level of 40 percent. Future campsites will have to plan the area for mobile homes at a distance greater than 100 meters from the sea.

With this proposal, the Ministry responded to the strong reactions from the camping industry last season, when the draft Law on Physical Planning defined mobile homes as buildings, which would require obtaining a building permit. That proposal banned the construction of any buildings within 100 meters of the sea and stipulated that campsites could be filled with mobile homes up to 40 percent, while 30 percent of the area had to remain green, and the remaining 30 percent was for access roads and areas for tents or campers.

The government has since relented, so mobile homes are no longer defined as buildings, although restrictions on campsite built-up levels remain in force. It is important to note that mobile homes still cannot be placed outside campsites-for example, on private land for residential purposes without a building permit.

What Can Be Renovated Without a Permit

The new regulation also expands the possibilities for renovation without a building permit. This will apply to houses up to 400 square meters with no more than two apartments, and to auxiliary buildings up to 600 square meters that are not used for industrial purposes. Such works will require a main project that must respect existing location conditions, meaning it will not be possible to add floors or new rooms, but changes to the facade or roof will be allowed. A construction notification and professional supervision remain mandatory.

Renovation without a building permit will also be possible on multi-apartment buildings, specifically for changes in the internal layout-such as removing partition walls or installing new systems.

As before, without a permit but with a project, it will be possible to install elevators, add external steel fire escapes, merge separate parts of a building into one unit, and build parapets up to 60 centimeters high and roof dormers.

Transition Period and Expected Adoption

For all works that begin within six months of the adoption of the new regulation, the provisions of the old regulation will apply. The public consultation on the proposal runs until September 3, 2026, and the final adoption of the document is expected by the end of this year.
